The parents of three-year-old Juan Andres Ruiz spent their Christmas at his gravesite. Andres was killed when he was struck by a car on November 1 in Encinitas.
Zenaida Ruiz was catching the bus on the morning of November 1, on her way to take Andres to preschool when the accident happened.

Officials initially believed the driver, Agustin Morales, was under the influence. But no DUI charges were filed because his blood alcohol level was .029.
