Tax Rules for Charitable Contributions

Charitable donations are common at year's end. The IRS offers some general rules if your donation goal is a legitimate tax deduction.

Editor's Note: I've disabled comments for this blog post at the blogger's request because the comments are not relevant to the post and notifications are flooding his inbox. 

Many taxpayers look to lower their tax bill as the year winds down. One of the more popular ways to do that is through charitable contributions. If your goal is a legitimate tax deduction through a cash or non-cash donation or donations, then read on for some highlights of the rules. In my next blog post, I’ll offer a few other common ideas to consider for year-end tax reduction.

You may claim a charitable donation deduction only if you itemize on IRS Schedule A. In other words, if you do not itemize your deductions, then you normally do not realize a tax benefit. For more on taking the standard deduction (based on your filing status) vs. itemizing, read here. In addition, you cannot deduct contributions made to specific individuals, political organizations or candidates.

Be sure you are giving to a qualified public charity. The IRS has a useful feature called Select Check that can help you in that regard. Select Check allows you to select an exempt organization (charity) and check certain information about its federal tax status and filings.

Contributions made on or before Dec. 31, 2012 are considered deductible for the 2012 tax year. Also, checks mailed or donations charged to a credit card by Dec. 31, 2012, are generally considered to be deductible in 2012.

If you receive a benefit because of your contribution such as merchandise, tickets to a ball game or other goods and services, then you can deduct only the amount that exceeds the fair market value of the benefit received.

Donations of stock or other non-cash property are usually valued at the fair market value of the property. Clothing and household items must generally be in good used condition or better to be deductible. Special rules apply to vehicle donations. (Fair market value is generally the price at which property would change hands between a willing buyer and a willing seller, neither having to buy or sell, and both having reasonable knowledge of all the relevant facts.)

Keep a paper trail such as receipts and paperwork for substantiation. If you claim a deduction for contributions of cash or property equaling $250 or more, you must have a bank record, payroll deduction records or a written acknowledgment from the qualified organization.

For text message donations, a telephone bill meets the record-keeping requirement if it shows the name of the receiving organization, the date of the contribution and the amount given.

Finally, if your total deduction for all noncash contributions for the year is more than $500, you must complete and attach IRS Form 8283, Noncash Charitable Contributions, to your return. Taxpayers donating an item or a group of similar items valued at more than $5,000 must also complete Section B of Form 8283, which generally requires an appraisal by a qualified appraiser.

By the way 70 to 80% of every dollar that goes through government gets eaten up by the expense of the government before it reaches the BOTTOM where it is suppose to be of some help. That is what Shane/ Jeff Kleiner is on. And yes June you are correct. More and more people are abusing the expanded definitions of SSI to get on it in unprecedented numbers. It is taking money from seniors and redirecting Social Security money to able bodied people that should not be on it. Poorer seniors should be outraged that their checks are smaller because of people like Jeff Kleiner.

Roy Holmgren couldn't get credit from the lowest loan shark- two foreclosures.....Never worked longer then 3 years for anyone and he didn't advance up the ladder. He was on unemployment three years ago. hsi Ex took him to court to bleed child support from him....after he beat her and abused his kids.....now this is June's best friend because they both believe in conservatism.

I did pay him a personal visit after and leaned on her FAT boyfriend and let him know if my kids ever get hurt he would be hospitalized for life. Gasoline prices averaged $3.3766 per gallon on Dec. 7, down 9.62 cents from Nov. 16, according to Trilby Lundberg, editor of the Lundberg Survey.
This marks the ninth week of straight declines, totaling 46.06 cents per gallon since prices hit $3.84 on Oct. 5. Thanks President Obama for doing such an amazing job on gas prices!!!!!!!!!!

As I correctly stated, Corporations DO NOT hire when they get tax breaks. They only hire due to demand. So lets look at where we are today, where Corporations are getting the highest tax breaks they have in history and no one is hiring. Corporate profits are currently at an all-time high (while worker wages as a percentage of the economy have plummeted to record lows). But despite those sky-high profits, corporate income tax revenue is projected to be just 1.5 percent of GDP this year, below the recent average and far below the amount raised by the tax just a few decades ago.
This is why 2/3 of Americans want to raise taxes on those making over 250K and on Corporations. This may not mean much in the long haul but at least it will bring fairness back into play.

I wholeheartedly agree with the recommendation that folks read the initiative. When you readRead More sections 6 and 9, you will see that Prop A sets a 30-foot or 2-story ceiling across the entire city, overriding lower height limits in many areas. The Downtown Specific Plan limits residences to 22-26 feet, as detailed on the DEMA website, so Prop A would actually allow the building of taller homes. It makes no exemptions or allowances for historic buildings like La Paloma, church towers or other structures over 30 feet high; the only exceptions are medical complexes and public high schools (see clause 6.2). Rebuilding or renovating (more than 50%) would require expensive public votes. Should the SRF be required to pay for an election to rebuild the Lotus Tower? Such contingencies are allowed for in our Historic Overlay Zone, which would clearly be overridden by Prop A. So is the Encinitas Preservation Association's plan to convert one of the boathouses to a museum. Again, Prop A would require an election (see section 4.1, clause e), which the EPA cannot afford. Prop A would thus favor large developers who have the money, time, lawyers and other resources to campaign for their project. How many nonprofits and small businessmen can afford to spend a minimum $30,000 just to get their project on a general election ballot (upwards of $300,000 for a special election like this one)? Yes, folks, please read the initiative, especially Section 9, which lays waste to anything that conflicts with it. That's why this has been dubbed Propzilla. I trust that most Encinitas citizens are smart enough to see that this meausre is deeply flawed, problematic and counter-productive. We can find much better ways to limit growth and preserve community character.

Lower set height limits will not be repealed, because they are not in conflict with the initiative or the General Plan. David Ahlgren's fear and speculation is not backed up by one single fact. He just raises the usual building industry "mantra" of alleged risks created by unnamed "unintended consequences." Council's attempt at a preemptive ordinance does NOT guarantee that will be placed on the ballot in 2014, and does NOT eliminate other loopholes such as the "less-than-5-acre" exception, the "categorization of intensity of use" exception, and the height limit exception. The only loophole that Council's drafted ordinance affects is Council's ability to vote by a 4/5 supermajority on upzoing if it is done with respect to a "significant public benefit." Not only is Council's recently drafted ordinance NOT guaranteed, in that a future Council could reverse it, if it is not enacted through a public vote, but also Council's attempt at preempting the "right to vote on upzoning and raising height limits initiative" DOESN"T eliminate the other loopholes that still exist in our General Plan, Policy 3.12., which exceptions I've spelled out, here.

The North 101 and Downtown Encinitas Specific Plans were pushed through by the Planning Department, the Planning Commission and a supermajority of past Council AGAINST the wishes of citizens, against years of feedback from Specific Action Review Committees (Sparc)s and Community Advisory Boards (CABs), who wanted to stay with the limits of the General Plan of two stories, 30 ft, MAX, with certain exceptions, consistent with the Initiative! Just posting your opinion without any supporting evidence, Mr. Stocks, is only hurting your "cause." We and everyone we know, all our friends and neighbors, are voting YES on A! Voting YES is best if you want to take back your ability to help slow growth and to take back local control.
